Terms of Use.
These Terms of Use are the contract between you and us when you use the website and services operated by İMSA Sağlık Hizmetleri (“NGS Advisory”). By using the service you are deemed to accept these Terms. The processing of personal data is carried out under a separate Privacy Notice and Explicit Consent Statement; this document does not replace them. It sits alongside them.
NGS Advisory is not a medical diagnosis or treatment service. The report it produces does not diagnose, does not prescribe any medication or treatment, and does not replace your treating physician. The final clinical decision rests solely with the treating physician.
The general terms applicable to every user of the website and services.
Parties and scope
These Terms of Use apply to every user (“you”) of the website and services operated by İMSA Sağlık Hizmetleri (“NGS Advisory”, “we”). By using the service you are deemed to have accepted these Terms.
Definition and nature of the service
NGS Advisory is a service that evaluates the molecular/NGS test results and clinical information of cancer patients, under specialist-physician supervision and with AI support, to produce a second-opinion, decision-support report.
Limits of medical responsibility
- The service is a decision-support tool intended for use by professionals (physicians); its outputs are reviewed and approved by a physician.
- AI-assisted outputs may contain inaccurate, incomplete or outdated information and do not, on their own, form a basis for a clinical decision.
- All decisions regarding the patient’s care (including treatment choices) belong to the treating physician’s independent assessment. NGS Advisory is not responsible for the medical care the physician does or does not provide.
- Do not use this service in an emergency; call your local emergency number or go to the nearest healthcare facility.
User obligations
- You represent that the information you provide is accurate, current and complete.
- If you are applying on behalf of someone else (e.g. a relative who is the patient), you represent that you are authorised to share their personal and health data and have obtained the necessary permissions.
- You will use the service only for lawful purposes and will not misuse the system (uploading malicious files, attempting unauthorised access, etc.).
- You will not reverse-engineer the website or software, attempt to obtain its source code or algorithms, scrape data with automated tools, place a disproportionate load on the infrastructure, attempt to bypass security measures, or transmit malware; and you will not use the report or service outputs to train any artificial-intelligence or machine-learning model not provided by NGS Advisory, or to develop a similar or competing product or service.
- You will not use the service or report, in the capacity of or on behalf of an insurer or employer, as a basis for insurance cover, risk assessment (underwriting), premium-setting or employment decisions.
- With respect to eligibility age and patients who are minors, clause A.12 applies.
Access and account
The site has no membership/account. Applications are taken via a form; the report is accessed through a personal, secure link sent to you, together with a second verification step using the last four digits of your phone number. Keeping this link and verification information confidential is your responsibility.
Confidentiality and personal data
The processing of your personal data is carried out under a separate Privacy Notice and Explicit Consent Statement. These Terms of Use do not replace them. (See the relevant documents.)
Intellectual property
All rights in the site content, reports and software belong to NGS Advisory. The report provided to you is for your personal/clinical use only; it may not be reproduced and distributed commercially without permission.
The report is allocated for personal and clinical use, to be shared only with the treating physician in the care process of the patient for whom it was prepared. The report may not be used with its content altered, may not have its source and ownership information removed, may not be reproduced and distributed commercially, and may not be sold to third parties. Because the report does not constitute a medical-diagnosis document, it may not (without NGS Advisory’s prior written approval) be used as evidence in legal disputes or as a basis for insurance, compensation, disability or employment decisions.
Limitation of liability
To the extent permitted by applicable law, NGS Advisory is not liable for indirect damages, for interruption of the service, or for disruptions arising from third-party service providers (payment, email, cloud). This clause does not limit your rights arising from mandatory consumer-protection law, or the provider’s liability arising from its own faulty or intentional conduct.
Changes
NGS Advisory may update these Terms from time to time. The current text is published on the website together with its effective date and takes effect on the date of publication. For material changes, reasonable prior notice is given where possible. Continuing to use the service after a change takes effect means acceptance of the current Terms.
Governing law and disputes
These Terms are governed by applicable law. In consumer transactions, you retain the mandatory rights granted to you under the consumer-protection law of your country of residence, and your right to apply to the competent authorities and courts is reserved.

Eligibility and patients who are minors
The person using the service must be over 18 and have legal capacity. If the report concerns a patient who is a minor or lacks legal capacity, the application may be made only by that patient’s parent or legal guardian. The person making the application represents and undertakes that they are legally authorised to apply on behalf of the minor or incapacitated patient, to transmit that patient’s health and personal data to NGS Advisory, and to consent to its processing. NGS Advisory provides the service in reliance on the existence of this authority and cannot be held responsible for consequences arising if it later emerges that the authority did not exist.
No physician-patient relationship is formed
Use of this Service does not create a physician-patient relationship between the applicant (or the patient on whose behalf the application is made) and NGS Advisory or the specialist physician who prepares/supervises the report; it does not amount to an examination, medical follow-up or assumption of treatment. The report is a second-opinion, decision-support document directed at the treating physician. The obligation of medical examination, diagnosis, treatment and follow-up rests solely with the treating physician who assesses the patient in person.
Third-party infrastructure and service providers
Third-party cloud-computing, AI/large-language-model and infrastructure providers may be used in delivering the service and in preparing and transmitting the report. NGS Advisory regulates the principles for the processing of personal and health data by these providers under a separate Privacy Notice and Explicit Consent Statement. NGS Advisory cannot be held responsible for disruptions that arise from these providers changing, interrupting or discontinuing their services and that fall outside NGS Advisory’s reasonable control. Rights arising from mandatory consumer-protection law and NGS Advisory’s liability arising from its own fault or intent are reserved.
Provision and availability of the service
The website and secure-link infrastructure are provided on a reasonable-efforts basis, ‘as available’. NGS Advisory makes no commitment that the service will be uninterrupted, error-free, always available or completed within a specific time; access may be temporarily suspended due to planned maintenance, technical failure or reasons beyond its control. This clause does not remove rights relating to defective service under mandatory consumer-protection law, or NGS Advisory’s liability arising from its fault or intent.
Suspension and termination of access
If NGS Advisory determines, or has reasonable suspicion, that these Terms have been breached, that the service has been misused, or that the secure link has been accessed without authorisation, it is entitled to take the security measures it deems necessary and to temporarily suspend or entirely cancel access to the personal secure link. Where legally required, this measure may be applied without prior notice.
Severability
If any provision of these Terms is held to be wholly or partly invalid, void or unenforceable, the validity and enforceability of the other provisions is not affected; the remaining provisions continue in force. The invalid provision is deemed replaced by a valid provision that is closest to the parties’ original intent.
Force majeure
NGS Advisory cannot be held liable for delay or non-performance arising from natural disaster, epidemic, war, terrorism, strike, decisions of public authorities, interruptions to electricity/internet/infrastructure, failures at cloud or AI service providers and similar events beyond its reasonable control. In such cases, performance of obligations is suspended for the duration of the force-majeure event.
Assignment and transfer
The user may not transfer their rights and obligations under these Terms to third parties without NGS Advisory’s written approval. NGS Advisory may transfer these Terms and the rights and obligations arising from them to third parties in the context of a merger, demerger, transfer of the business or relevant assets, or restructuring, provided that this does not materially adversely affect the user’s rights under these Terms.
Feedback
For suggestions, comments and improvement ideas that the user voluntarily sends regarding the service (‘Feedback’), NGS Advisory is deemed to be granted the right to use them, free of charge and without time limit, to improve its services. This clause covers only free-form feedback that does not constitute health data; the patient’s personal and special-category health data are in all cases subject to the separate Privacy Notice and Explicit Consent Statement regime and may not be used under this clause.
Under applicable consumer-protection law for distance contracts, this is provided before the application/payment step for all paid tiers (Standard / STAT / Priority).
