Terms of Use
General terms and conditions applicable to every user of the website and the services.
General terms
Parties and scope
These Terms are binding on everyone who uses the website and the Service.
These Terms of Use apply to every user (“you”) of the website and services operated by İMSA Sağlık Hizmetleri Sanayi ve Ticaret (“NGS Advisory”, “we”). By using the Service, you are deemed to have accepted these Terms.
Description and nature of the Service
The Service is an AI-supported decision-support report prepared under physician supervision.
NGS Advisory is a service that evaluates cancer patients' molecular/NGS test results and clinical information, under the supervision of a specialist physician and with the support of artificial intelligence, to produce a decision-support report in the nature of a second opinion.
Nature of the Service
The Service is not a medical diagnosis or treatment service. The report it produces does not provide a diagnosis, does not prescribe any medication or treatment, and does not replace your treating physician. The final clinical decision rests solely with the treating physician. The Service is a second opinion that supplements, and does not replace, your existing medical care.
Limits of medical responsibility
All clinical decisions remain the independent responsibility of the treating physician.
- The Service is a decision-support tool designed for use by professionals (physicians); its outputs are reviewed and approved by a physician.
- AI-supported outputs may contain information that is incorrect, incomplete, or no longer current, and may not serve as the sole basis for any clinical decision.
- All decisions concerning the patient's care (including treatment choices) rest with the independent judgment of the treating physician. NGS Advisory is not responsible for medical care provided, or not provided, by the physician.
- Do not use this Service in an emergency; call your local emergency number or go to the nearest healthcare facility.
Nature and limitations of artificial intelligence
additional provisionThe report is prepared through processes supported by generative artificial intelligence (including large language models). AI outputs may contain information that is incorrect, incomplete, inconsistent, or fabricated (a ‘hallucination’), and, owing to the training-data cutoff date of the model, may not reflect the most current scientific literature. Although the final report undergoes review by a specialist physician, that review does not mean that every element of the raw AI output has been independently verified. The treating physician is obliged to independently assess and verify every finding in the report in light of the physician's own professional knowledge, the patient's clinical condition, and current guidelines. The report may not be used as the sole basis for any clinical decision.
User obligations
Provide accurate information, be authorized to apply on another's behalf, and do not misuse the Service.
- You represent that the information you provide is accurate, current, and complete.
- If you are applying on behalf of another person (for example, a family member who is the patient), you represent that you are authorized to share that person's personal and health data and that you have obtained the necessary consents.
- You will use the Service only for lawful purposes and will not misuse the system (including by uploading harmful files or attempting unauthorized access).
- You will not reverse-engineer the website or the software, attempt to obtain its source code or algorithms, scrape data using automated tools, impose a disproportionate load on the infrastructure, attempt to circumvent security measures, or transmit malicious software; nor will you use the report or the Service's outputs to train any artificial intelligence or machine-learning model not provided by NGS Advisory, or to develop a similar or competing product or service.
- You will not use the Service or the report, in the capacity of or on behalf of an insurer or employer, as a basis for insurance coverage, underwriting, premium determination, or employment decisions.
- Article A.12 applies with respect to the eligibility age and minor patients.
Access and account
There is no membership; the report is accessed via a personal secure link and the last 4 digits of your phone number.
The website does not have a membership or account system. Applications are submitted through a form; the report is accessed through a personal, secure link sent to you, together with a second verification step using the last four digits of your phone number. It is your responsibility to keep this link and the verification information confidential.
Privacy and personal data
Data processing is governed by a separate Privacy Notice and Explicit Consent Statement.
The processing of your personal data is governed by a separate Privacy Notice and Explicit Consent Statement. These Terms of Use do not replace those documents. (Please refer to the relevant documents.)
Intellectual property
The report is allocated solely for the relevant patient's care, to be shared with their physician.
All rights in the website content, the reports, and the software belong to NGS Advisory. The report provided to you is for your personal/clinical use only; it may not be reproduced or distributed for commercial purposes without authorization.
The report is allocated for personal and clinical use, to be shared solely with the treating physician in the course of the care of the patient for whom it was prepared. The report may not be used with its content altered, its source and ownership information may not be removed, it may not be reproduced or distributed for commercial purposes, and it may not be sold to third parties. As the report does not constitute a medical diagnostic document, it may not be used as evidence in legal disputes, or as a basis for insurance, compensation, disability, or employment decisions, without the prior written consent of NGS Advisory.
Limitation of liability
Indirect damages and third-party-caused disruptions are excluded; consumer rights remain reserved.
To the extent permitted by applicable law, NGS Advisory is not liable for indirect damages, service interruptions, or disruptions arising from third-party service providers (payment processing, email, cloud services). This provision does not limit your rights under mandatory consumer protection legislation, or the Provider's liability arising from its own negligent or intentional conduct.
Amendments
The current text is published on the website; continued use constitutes acceptance.
NGS Advisory may update these Terms from time to time. The current text is published on the website together with its effective date and takes effect on the date of publication. For material changes, notice will be given as far in advance as reasonably possible. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
Eligibility and minor patients
The user must be over 18; only a legal representative may apply on behalf of a minor patient.
The person using the Service must be over 18 years of age and possess legal capacity. If the report concerns a patient who is a minor or lacks legal capacity, the application may be submitted only by that patient's parent or legal representative. The person submitting the application represents and warrants that they are legally authorized to apply on behalf of the minor or incapacitated patient, to transmit that patient's health and personal data to NGS Advisory, and to consent to its processing. NGS Advisory provides the Service in reliance on the existence of such authority and may not be held liable for any consequences arising should it subsequently emerge that such authority did not in fact exist.
No physician-patient relationship
Use of this Service does not create a physician-patient relationship between the applicant (or the patient on whose behalf the application is made) and NGS Advisory, or the specialist physician who prepares/supervises the report, and does not constitute the undertaking of an examination, medical follow-up, or treatment. The report is a decision-support document in the nature of a second opinion, directed to the treating physician. The obligation to conduct a medical examination, and to diagnose, treat, and follow up the patient, rests solely with the treating physician who personally evaluates the patient.
Third-party infrastructure and service providers
Cloud and AI providers are used; disruptions caused by them are outside our reasonable control.
Third-party cloud computing, artificial intelligence/large language model, and infrastructure providers may be used in providing the Service and in preparing and transmitting the report. NGS Advisory sets out the principles governing the processing of personal and health data by these providers in a separate Privacy Notice and Explicit Consent Statement. NGS Advisory may not be held liable for disruptions arising from these providers modifying, interrupting, or discontinuing their services, where such disruptions fall outside NGS Advisory's reasonable control. Rights arising under mandatory consumer protection legislation, and NGS Advisory's liability arising from its own negligence or willful misconduct, remain reserved.
Provision and availability of the Service
The website is provided on a reasonable-efforts, “as is” basis; uninterrupted operation is not guaranteed.
The website and the secure-link infrastructure are provided on a reasonable-efforts basis and on an ‘as is’ basis. NGS Advisory does not warrant that the Service will be uninterrupted, error-free, available at all times, or completed within a specific timeframe; access may be temporarily suspended for scheduled maintenance, technical failure, or reasons beyond its control. This provision does not eliminate any rights relating to defective services under mandatory consumer protection legislation, or NGS Advisory's liability arising from its own negligence or willful misconduct.
Suspension and termination of access
The secure link may be suspended or revoked in cases of suspected violation or unauthorized access.
If NGS Advisory determines, or reasonably suspects, that these Terms have been violated, that the Service has been misused, or that unauthorized access to the secure link has occurred, it is entitled to take such security measures as it deems necessary and to temporarily suspend or permanently revoke access to the personal secure link. Where legally required, such measures may be implemented without prior notice.
Severability
If a provision is held invalid, the remaining provisions remain in effect.
If any provision of these Terms is held to be invalid, void, or unenforceable, in whole or in part, the validity and enforceability of the remaining provisions shall not be affected, and those provisions shall remain in full force and effect. The invalid provision shall be deemed replaced by a valid provision that most closely reflects the parties' original intent.
Force majeure
Obligations are suspended in the event of circumstances beyond our control.
NGS Advisory may not be held liable for any delay or failure to perform arising from natural disaster, epidemic, war, terrorism, strikes, decisions of public authorities, electricity/internet/infrastructure outages, failures at cloud or artificial intelligence service providers, and similar events beyond its reasonable control. In such cases, performance of the obligations concerned is suspended for the duration of the force majeure event.
Assignment and transfer
The User may not assign its rights; NGS Advisory may assign in the event of a restructuring.
The User may not assign the rights and obligations arising from these Terms to third parties without the prior written consent of NGS Advisory. NGS Advisory may assign these Terms, and the rights and obligations arising from them, to third parties in connection with a merger, demerger, transfer of the business or related assets, or restructuring, provided that this does not materially adversely affect the User's rights under these Terms.
Feedback
Voluntary suggestions may be used free of charge; health data is not covered by this provision.
With respect to any suggestions, comments, and improvement ideas voluntarily submitted by the User regarding the Service (‘Feedback’), NGS Advisory is deemed to be granted a royalty-free, perpetual right to use such Feedback to improve its services. This provision covers only free-form feedback that does not constitute health data; the patient's personal data and special-category health data remain, in all cases, subject to the separate Privacy Notice and Explicit Consent Statement regime and may not be used under this provision.
Governing law and disputes
Your mandatory rights as a consumer in your country of residence remain reserved.
These Terms are governed by the applicable law. In consumer transactions, the mandatory rights granted to you under the consumer protection legislation of your country of residence are reserved, and your right to apply to the competent authorities and courts remains unaffected.

- Seller / Provider
- İMSA Sağlık Hizmetleri Sanayi ve Ticaret · Orta Mah. Numunebağ Cad. İmren Han No: 48/34, Bayrampaşa / İstanbul · Halkalı Tax Office, Tax No. 474 060 3681 · [email protected]
- Key characteristics of the Service
- An AI-supported molecular oncology second-opinion decision-support report, prepared under the supervision of a specialist physician (see A.2). It is not a diagnostic/treatment service.
- Service tiers
- All three tiers carry the same fee; the difference lies in delivery speed and payment timing. STAT: 24 hours · Priority: 48 hours · Standard: 72 hours (calculated from the time all required information/documents are received in full).
- Total price
- USD 2,800 (VAT included). Services provided to patients residing abroad are treated as a service export and are exempt from VAT (0%); in that case, the price is likewise USD 2,800. For domestic consumers, the price is also displayed in the local currency.
- Method of payment
- By online card payment via the PayTR infrastructure (card data is not stored by us). Payment timing varies by tier: STAT: the full amount is paid in advance upon application; Priority: half is paid upon application, with the remaining half paid when the report is released; Standard: no advance payment; the full amount is paid once the report is prepared and a “ready” notification is sent, at which point the report is released.
- Manner and time of performance
- Once all required information/documents (NGS results, clinical information) have been received in full, the report is prepared within the timeframe of the selected tier (STAT 24 hours / Priority 48 hours / Standard 72 hours). A “ready” notification is sent once the report is complete; upon payment of the amount (or the remaining balance), the report is released via the secure link.
- Right of withdrawal
- 14 days, HOWEVER, the exception below applies.
Exception to the right of withdrawal
Under the applicable distance-selling rules, the right of withdrawal may not be exercised for services whose performance has begun with the consumer's consent. In all tiers that commence immediately with your consent (Standard/STAT/Priority), performance is deemed to have begun at the moment preparation of the report starts, and your right of withdrawal thereupon terminates. For this reason, your consent to “immediate performance and the resulting loss of the right of withdrawal” is obtained at the application step (Form Box 2).
