Distance Sales Agreement.
This Agreement applies to all paid tiers: Standard, STAT and Priority. It is concluded upon the Buyer’s electronic approval; a copy is delivered to the Buyer electronically. The processing of personal data is carried out under the separate Privacy Notice and Explicit Consent Statement.
NGS Advisory is not a medical diagnosis or treatment service. The report produced does not diagnose, does not prescribe medication/treatment, and does not replace your treating physician. The final clinical decision rests solely with the treating physician.
Parties
Subject
The subject of this Agreement is the provision of the second-opinion decision-support report service, ordered electronically by the Buyer, whose features and price are set out in the Pre-Contract Information Form.
Service and fee
- Selected tier: STAT (24 hours) / Priority (48 hours) / Standard (72 hours), and all three tiers carry the same fee.
- Payment (online via Iyzico): STAT: full amount paid upfront at application; Priority: half at application, the remaining half when the report is released; Standard: no upfront payment; the full amount is paid after the report is prepared and the notification is sent.
Performance
The service is performed within the timeframe of the selected tier (STAT 24 hours / Priority 48 hours / Standard 72 hours) after all information/documents required for performance (NGS results, clinical information) have been received in full; once the report is prepared, a “ready” notification is sent, and upon completion of payment (the full amount for Standard, the remaining balance for Priority) the report is made accessible to the Buyer via a secure link.
In the Standard tier, preparing the report before payment constitutes early commencement of performance with the Buyer’s express consent (see Article 6).
Nature of the service and medical responsibility
The Buyer acknowledges that the service is not a medical diagnosis/treatment, that it is a second-opinion decision support, and that the final decision rests with the treating physician (see A.2, A.3). The fee for the service does not guarantee any treatment outcome or any specific clinical benefit.
Right of withdrawal and its exception
As a rule, the Buyer has the right to withdraw from the Agreement within 14 days.
In all tiers, the Buyer provides the following consent at the application step (Form Box 2). The right of withdrawal ends once preparation of the report begins:
If performance has not yet begun, the Buyer may exercise the right of withdrawal via [email protected] and the payment will be refunded.
Obligations of the parties
- Buyer: accurate/complete information and the required authorization declaration (see A.4); payment.
- Provider: to provide the service with care and confidentiality, within the announced SLA; to protect personal data under the Privacy Notice / Explicit Consent Statement.
Dispute resolution
Any dispute arising in connection with this Agreement shall be resolved in accordance with applicable consumer-protection legislation.
Effectiveness
The Agreement is concluded and enters into force upon the Buyer’s electronic approval. A copy is delivered to / made accessible to the Buyer electronically.
